Site does not rank for its own name in Google

- Description: My domain name http://tinyurl.com/39vpw6w does not show up for it's name/trademark in Google. My domain shows up on page 5-6 in Google. It should have the number one spot.
On the other search engines like Yahoo and Bing it has the number one spot.
I searched online, and it says if a website does not rank for the name/trademark of a domain name it is very likely a penalty and under some kind of trademark suppression. Can someone help me pinpoint and unwind this penalty?
